Steve Wakefield reserves and retains the Copyright of all images taken or created by Steve Wakefield. This includes images created from images provided by the client for enhancement or restorative work.
This means that no-one can copy the images (or any part of the image) in any way, unless licensed by Steve Wakefield to do so. This includes photocopying, scanning, photographing the image or any part of it. This includes uploading an image, taken by Steve Wakefield, to the internets as this creates a copy of the image and is prohibited by the Copyright, unless you have a licence to do so.
Licences
You can purchase a licence that allows you to copy images for your own use or commercial use. Licences cover specified images in singles or multiples. They specify how you can copy an image. If you purchase a licence you will be provided with the image digitally recorded on DVD or CD as well as a written licence.
Breach of intellectual rights will cause a claim for damages that will be referred to the jurisdiction of the Courts of England and Wales irrespective of the location of the breach.
Privacy Policy
This covers the privacy of images taken/created by Steve Wakefield. The client is the person who has booked my services. The privacy of images is concerned with the client and not the subject(s) recorded in the image.
Images remain the property of Steve Wakefield. This policy covers how Steve Wakefield will use, show or display the images.
There are two levels of Privacy applied to images at the discretion of Steve Wakefield. Unless otherwise agreed in writing images will be subject to Normal Privacy. There is also Restricted Privacy.
Using Images in Advertising
There are two main types of advertising for the purposes of this policy. ‘General Advertising’ refers to undirected adverts that are randomly distributed. Examples are TV, newspaper, leaflets etc. An image also may be used as a portfolio example. This is when a prospective client wishes to see examples of Steve Wakefield’s work are provided with, or shown, a specific portfolio of examples.
Normal Privacy
Steve Wakefield;
may destroy or delete any image at any time.
will provide the client with the samples to select photographs and any computer links to web sites. The client may circulate these samples to whoever they choose. Steve Wakefield will not provide samples to any person who is not the client except at the request of the client;
will fulfil an order for images to the client and orders from a guest of the client providing the guest is either the sole subject of the image ordered or the client has allowed the guest access to the samples or otherwise sanctions the order.;
may use any image in general advertising or as a portfolio example. When used in general advertising the client’s permission will be sought using the contact details held on file. If the client cannot be reasonably contacted or does not reply to the request within 28 days Steve Wakefield reserves the right to use the image in General Advertising. When used as a portfolio example permission is not sought.
Restricted Privacy
This can be applied to a single image or the whole group of images at the discretion of Steve Wakefield. This seeks to restrict the image’s use in advertising and the access to images. Typically Restricted Privacy is used for private portraits, security photography (images of expensive items for insurers) etc.
For images graded as Restricted Steve Wakefield;
may destroy or delete any image at any time;
will provide the client with the samples to select photographs. Samples will be provided separately to any Normal Privacy samples. The client may circulate these samples to whoever they choose. Steve Wakefield will not provide samples to any person who is not the client unless authorised by or at the request of the client, in writing (including digital);
will fulfil an order for photographs to the client. Orders made by a guest of the client will only be fulfilled if the order is sent via the client and countersigned by the client;
may use the image in general advertising or as a portfolio example only with the client’s written permission. If the client’s permission cannot be obtained Steve Wakefield will not use the image in any form of advertising including a portfolio.
In either case additional restrictions/exclusions can be added specific to a particular project. In this case these additions will be agreed in writing.
